By using the Site or the Services, you agree to the practices described in this policy. If you do not agree, please do not use the Site or the Services.

1. Who this policy covers

Cautivo provides an AI-powered front office for local service businesses. Our Services include a website with pages for each service and city, an AI voice agent that answers phone calls, an AI chat agent that answers website chats, a CRM and calendar, review request and review reply tools, and referral and annual-service email follow-ups.

This policy applies to two groups of people:

  • Visitors and prospective clients who use our Site, call or chat with our demo agents, or contact us. For this information, Cautivo decides how and why the data is used.
  • Customers of our business clients who call or chat with an AI agent we operate on a client’s behalf. For this information, we act as a service provider to that business. The business decides what to do with the data, and its own privacy policy also applies.

2. Information we collect

Information you give us. This includes your name, phone number, email address, business name, business address, and the details you share when you contact us, complete our setup form, book an appointment, or request a service. It also includes the content of anything you say or write to us.

Calls and chats with our AI agents. When you call our voice line or use our chat, we collect:

  • Audio recordings of the call.
  • Word-for-word transcripts of calls and chats.
  • The phone number or contact details you provide.
  • What you asked for, the answers given, and any appointment booked.
  • Call time, duration, and related metadata.

Information collected automatically. When you visit the Site, we and our providers may collect your IP address, browser and device type, operating system, pages viewed, referring page, time spent, and approximate location. We collect this through cookies, pixels, and similar technologies.

Information from third parties. We may receive information from the businesses we serve, from public sources such as Google Business Profile listings and online reviews, and from our calendar, communication, and analytics providers.

Payment information. Payments are handled by third-party payment processors. We do not store full card numbers on our systems.

3. Recording, transcription, and AI analysis

Calls and chats are recorded and transcribed. Our AI agents tell you at the start of an interaction that they are a virtual assistant and, on phone calls, that the call is recorded. If you continue the call or chat after that notice, you consent to the recording and transcription. If you do not want to be recorded, please end the call and contact the business directly.

How we use recordings and transcripts. We use them to:

  • Deliver the service, including qualifying leads, answering questions, and booking appointments.
  • Send the business client a copy of the recording, transcript, and booking confirmation.
  • Store the interaction in the client’s CRM.
  • Review, analyze, and improve the accuracy, quality, and performance of our AI agents and Services, including tuning responses, fixing errors, and improving how the agents understand and answer callers.
  • Monitor quality, resolve disputes, and train our staff.
  • Detect fraud, abuse, and security issues.

AI limitations. Our AI agents can make mistakes. They are designed to say they will follow up when they don’t know an answer, and not to invent prices, services, or details. Important decisions should not rely only on what an AI agent said.

No sale of recordings. We do not sell recordings or transcripts. We do not use them for advertising unrelated to the Services.

Service providers. To transcribe and analyze interactions, we use third-party service providers, including AI, speech-to-text, and cloud infrastructure providers. They may process this information only on our instructions and to provide services to us.

4. How we use personal information

We use personal information to:

  • Provide, operate, maintain, and secure the Services.
  • Answer calls and chats, book appointments, and send confirmations.
  • Create and manage contacts, appointments, and reviews in our CRM and calendar tools.
  • Send review requests, referral emails, and service reminders on behalf of our clients.
  • Respond to your questions and provide support.
  • Improve and develop our Services, including our AI, as described in Section 3.
  • Send you service updates and, where permitted, marketing messages.
  • Analyze Site usage and measure marketing performance.
  • Comply with legal obligations and enforce our agreements.

5. Text messages and email

If you give us your phone number, we or our clients may contact you by phone, SMS, or email about your request, appointment, or service. Message and data rates may apply. You can reply STOP to opt out of text messages at any time and HELP for help. You can unsubscribe from marketing emails using the link in each email. We do not share mobile phone numbers or SMS opt-in data with third parties for their own marketing purposes.

6. How we share information

We share personal information only as described below:

  • Business clients. If you interact with an AI agent we run for a business, that business receives your information, recordings, and transcripts.
  • Service providers. We share information with vendors who help us run the Services, such as CRM, telephony, messaging, email, AI and transcription, hosting, calendar, analytics, and payment providers.
  • Connected accounts. If a client connects tools such as Google Calendar or Google Business Profile, information is exchanged with those services.
  • Legal and safety. We may disclose information to comply with the law, respond to legal process, protect rights, safety, and property, or prevent fraud.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
  • With your consent. We may share information for other purposes when you ask us to or agree to it.

We do not sell your personal information for money.

7. Cookies and tracking technologies

We use cookies and similar technologies to keep the Site working, remember preferences, understand how visitors use the Site, and measure advertising. You can control cookies through your browser settings. Blocking some cookies may affect how the Site works. Where required, we honor opt-out preference signals such as Global Privacy Control.

8. Data retention

We keep personal information for as long as needed to provide the Services, meet legal, tax, and accounting requirements, resolve disputes, and enforce our agreements. Recordings and transcripts are kept for as long as the business client’s account is active, or as the client instructs, and are then deleted or anonymized within a reasonable period after the account closes. You may ask us to delete your information as described in Section 10.

9. Data security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your privacy rights

Depending on where you live, you may have the right to:

  • Know what personal information we collect, use, and share.
  • Access a copy of your personal information.
  • Correct inaccurate information.
  • Delete your personal information, subject to legal exceptions.
  • Opt out of the sale or sharing of personal information, or of targeted advertising.
  • Limit the use of sensitive personal information.
  • Not be discriminated against for exercising your rights.

To make a request, email mail@cautivo.co or call +1 (728) 233-8022. We may need to verify your identity before responding. If your request concerns a call or chat with an AI agent operating for one of our clients, we may direct you to that business or process the request on its behalf. You may use an authorized agent to submit a request, and we may ask for proof of authorization. If we deny a request, you may appeal by replying to our response.

California residents. Under the California Consumer Privacy Act, you have the rights listed above. In the past 12 months, we have collected the categories of information described in Section 2 and disclosed them for business purposes to the recipients in Section 6. We do not sell personal information and do not knowingly sell or share the personal information of anyone under 16.

11. Children's privacy

The Site and Services are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, contact us and we will delete it.

12. Third-party links and services

The Site may link to third-party websites and services. We are not responsible for their privacy practices. Please read their policies.

13. International visitors

Cautivo is based in the United States and our Services are intended for use in the United States. If you access the Site from another country, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

14. Changes to this policy

We may update this policy from time to time. When we do, we will change the “Last updated” date above and, for material changes, give additional notice where appropriate. Your continued use of the Site or Services after an update means you accept the revised policy.
